Terms of Service

These Beta Terms of Service ("Terms") are a binding agreement between you ("you" or "Tester") and Keystone AI LLC, an Illinois limited liability company ("Keystone," "we," "us," or "our"), which operates the Living Yard Coach product and brand ("Living Yard Coach," the "Service"). By creating an account, clicking "I agree," or otherwise accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. This Is a Beta — Read This First

The Service is pre-release, experimental software provided for testing and evaluation. That means:

  • Features may be incomplete, may not work as intended, and may change or disappear at any time, without notice.
  • The Service may be unavailable, interrupted, slow, or contain bugs or errors.
  • We may modify, suspend, or discontinue the Service — or any Tester's access — at any time, for any reason, without liability to you.
  • Your data may be lost, corrupted, reset, or deleted during the beta. Do not rely on the Service as the sole record of anything important to you. Keep your own copies of any content you care about.

You use the beta at your own risk and with the understanding that it is not a finished product.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that the registration information you provide is accurate.

3. Your Account

You are responsible for your account credentials and for all activity under your account. Notify us promptly at david@livingyard.net if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. The Beta Is Free

The Service is provided free of charge during the beta period. We are not obligated to continue offering it for free. When the Service leaves beta, continued access may require a paid subscription under separate terms, and free beta access may end. We will give you reasonable notice before any such change affects you.

5. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service during the beta for your own non-commercial evaluation and gardening use. You may not resell, sublicense, reverse-engineer, scrape, or build a competing product from the Service, or use it in violation of law.

6. Your Content and Your Data

"Your Content" means the information and materials you provide to the Service, including: account details; garden, bed, plant, and site/location data; photos and other uploads; voice recordings and audio input; and the messages you send in chats or conversations with the AI coach.

  • You own Your Content. These Terms do not transfer ownership of it to us.
  • You grant us a license to host, store, copy, process, display, and transmit Your Content, and to create derived data (such as transcriptions, embeddings, and analysis), solely to operate, provide, secure, and improve the Service and as described in these Terms and our Privacy Policy.
  • Third-party processing. To provide AI features, Your Content — including chat messages, transcribed voice input, and uploaded photos — may be sent to and processed by third-party service providers, such as AI model providers (e.g., Anthropic, OpenAI), speech-to-text providers, and cloud hosting and database providers. Their handling of data is governed by their own terms. Do not submit anything you are not comfortable sharing with these providers.
  • No biometric use. We use voice recordings only to transcribe your words, and photos only to power gardening features (such as plant identification and site analysis). We do not use voice or images to create a voiceprint, faceprint, or any other biometric identifier, and we do not use them for voice or facial recognition to identify you.
  • You are responsible for having the rights to any content you upload (for example, photos), and for not submitting anyone else's personal, confidential, or sensitive information without permission.

7. AI Features — Important Limitations

The Service uses artificial intelligence to generate gardening guidance, suggestions, plant information, and other outputs ("AI Outputs"). You understand and agree that:

  • AI Outputs may be inaccurate, incomplete, or wrong. They are generated automatically and are not reviewed by a human expert.
  • AI Outputs are for general informational purposes only and are not professional advice. The Service is not a substitute for a qualified horticulturist, arborist, agronomist, pesticide applicator, medical professional, or other expert.
  • Do not rely on the Service for any safety-critical decision, including but not limited to: whether a plant, berry, mushroom, or other material is edible, poisonous, or toxic to people or animals; plant or pest identification; and the selection, mixing, or application of fertilizers, pesticides, herbicides, or other chemicals. Always verify with an authoritative source and follow all product labels and local laws. When in doubt, consult a professional.
  • You are solely responsible for how you act on AI Outputs, and for any results in your yard, garden, or property.

8. Feedback

We would love your feedback. If you send us ideas, suggestions, bug reports, or other feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose, without any obligation or compensation to you. Feedback is not your confidential information.

9. Please Keep the Beta Reasonably Private

The Service, and non-public features you see during the beta, are confidential to us. We ask that you not publicly post screenshots, recordings, or detailed descriptions of unreleased features without our permission. Sharing your own general experience is fine.

10. Acceptable Use

You agree not to: (a) use the Service unlawfully or to harm others; (b) upload malicious code, or attempt to disrupt, overload, probe, or gain unauthorized access to the Service or its infrastructure; (c) upload content that is illegal, infringing, or that you lack the rights to; (d) misrepresent the Service's outputs as professional advice to third parties; or (e) use the Service to develop a competing product. We may remove content or suspend access for violations.

11. Third-Party Services

The Service relies on third-party providers (for AI, hosting, storage, transcription, authentication, and similar functions) and may link to third-party sites. We are not responsible for third-party services, and your use of them may be subject to their terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI Outputs or any other content will be accurate or reliable. This is beta software, and you accept the associated risks.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KEYSTONE AI LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PLANTS, PROPERTY, OR OTHER LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for all claims relating to the Service will not exceed one hundred U.S. dollars (US $100.00). Because the beta is provided free of charge, you acknowledge this allocation of risk is reasonable.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Keystone AI LLC and its members, managers, and employees from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

15. Term and Termination

These Terms apply for as long as you use the Service. You may stop and delete your account at any time. We may suspend or terminate your access, and may end the beta, at any time and for any reason. On termination, your license ends and we may delete Your Content, subject to our Privacy Policy and applicable law. Sections that by their nature should survive (including 6–8 and 12–17) survive termination.

16. Changes to These Terms

We may update these Terms as the beta evolves. If we make material changes, we will take reasonable steps to notify you (for example, by email or in-app notice). Your continued use after changes take effect means you accept the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules.

Informal resolution first. If you have a dispute with us, please contact us at david@livingyard.net first and give us 30 days to try to resolve it informally. Most issues can be resolved this way.

If we cannot resolve it, the dispute will be brought exclusively in the state or federal courts located in McHenry County, Illinois, and you and we consent to personal jurisdiction there. Each party is responsible for its own costs unless a court orders otherwise.

18. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service, and supersede any prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
